General Terms and Conditions

1. Scope

The following terms and conditions apply to all orders placed via our online store. Our online store is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Contractual partner, conclusion of contract, correction options

The purchase contract is concluded with La Votre Dress.

By placing the products in the online shop, we make a binding offer to conclude a contract for these products. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking on the order button. Immediately after submitting your order, you will receive another confirmation by email.

We store the contract text and send you the order data and our terms and conditions in text form. You can view the contract text in our customer login.

4. Delivery conditions

Shipping costs

Shipping costs are added to the stated product prices. You can find out more about the shipping costs in the offers.

Delivery options

We ship the products to the delivery address specified during the ordering process.

We only deliver by mail. Unfortunately, it is not possible to pick up the goods yourself.

5. Payment

The following payment methods are generally available in our shop.

Prepayment

If you select the prepayment method, we will send you our bank details in a separate email and deliver the goods after receipt of payment.

Credit card

You enter your credit card details during the ordering process. Your card will be charged immediately after placing the order.

SEPA direct debit

By placing your order, you issue us with a SEPA direct debit mandate. We will inform you of the date on which your account will be debited at least one banking day in advance (known as prenotification). A banking day is any working day except Saturdays, federal public holidays, and December 24 and 31 of each year. Your account will be debited before the goods are shipped.

PayPal, PayPal Express

In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. You will receive further information during the ordering process.

PayPal may offer registered PayPal customers selected according to its own criteria additional payment options in their customer account. However, we have no influence on the offering of these options; additional individually offered payment options affect your legal relationship with PayPal. You can find more information on this in your PayPal account.

6. Reservations & deposits

Binding reservation:

By completing the reservation, you agree that the selected goods (e.g., clothing, accessories) will be reserved exclusively for you for the agreed period. The reservation only becomes binding after receipt of the deposit.

Deposit:

The amount of the deposit is specified during the reservation process and serves to secure the goods for you. Once the deposit has been paid, the reservation is considered binding.

Cancellation/withdrawal:

Withdrawal from the reservation is not possible. In the event of cancellation or non-acceptance of the reserved goods, the deposit will be forfeited in full. This provision also applies expressly to consumers (§ 312g BGB), as this is a service with a specific date or the goods are reserved specifically for you.

7. Warranty and guarantees

7.1 Liability for defects

The statutory liability for defects applies.

7.2 Warranties and customer service

Information on any additional warranties that may apply and their exact terms and conditions can be found with the product and on special information pages in the online shop.

8. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

9. Final provisions

(1) Contracts between the provider and the customer are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The statutory provisions restricting the choice of law and the applicability of mandatory provisions, in particular those of the country in which the customer as a consumer has their habitual residence, remain unaffected.

(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the provider's registered office.

(3) Even if individual points of the contract are legally invalid, the remaining parts of the contract remain binding. The invalid points shall be replaced by the statutory provisions, if any. However, if this would constitute an unreasonable hardship for one of the contracting parties, the contract shall become invalid in its e
